This Privacy Policy addresses Knack’s practices regarding information collected from users of the web properties of Knack, including but not limited to all main and subdomains of knackbags.com (the “Site”).

Purpose of this privacy policy

This privacy policy aims to give you information on how Knack collects and processes your personal data through your use of this Site (regardless of where you visit it from), including any data you may provide through this Site when you place an order on the Site, when you establish an account with us, when you contact us with a question or comment, when you utilize our "Email to a Friend" feature, or when you sign up to receive emails about our latest products and services.

This Privacy Policy does not address or govern any information-gathering, use, or dissemination practices related to information collected from you other than directly through or from the Site, such as from other websites, telephone, facsimile, postal mail, personal delivery, or other or additional offline means or media.

This Privacy Policy is incorporated into Knack’s Terms and Conditions for the Site by reference, as if set forth fully therein, which must be reviewed and accepted by you if you register an account with our Site .

It is important that you read this Privacy Policy together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal information about you so that you are fully aware of how and why we are using your information. This Privacy Policy supplements other notices and privacy policies and is not intended to override them.

We have appointed a data privacy manager who is responsible for overseeing questions in relation to this Privacy Policy.   1. Information We May Collect

Personal Information

For purposes of this Privacy Policy, “personal information” means any information by which someone or a household (as applicable, based on the privacy laws that apply to your Personal Information) can be personally identified, including name, address, telephone number, email address, and other information incidental to providing goods or services (also referred to herein as “personal information”). It does not include data where the identity has been removed (anonymous data) and the individual or household cannot otherwise be re-identified.

We may collect, use, store and transfer different kinds of personal information about you which we have grouped together as follows:

  • Identity Data includes first name, maiden name, last name, and company/organization name.
  • Contact Data includes billing address, delivery address, email address and telephone numbers.
  • Financial Data includes bank account and payment card details.
  • Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
  • Technical Data includes your internet protocol (IP) address, your mobile device’s unique ID number, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this Site.
  • Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
  • Usage Data includes information about how you use our Site, products and services, such as the buttons, controls, products, pages of our Site that you visit, the time spent on those pages, the dates and times of your visits, but also about the webpage you were visiting before you came to our Site and the webpage you go to next.
  • Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
  • Employment and Education Data includes your CV information (job applicants), job title, and employer name.

 

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

Browsing Information and Cookies

The Site also uses a browser feature known as a cookie, which assigns a unique identification to your device. The information collected from cookies allows us to provide better customer service to you and to improve features of our Site in a variety of ways, including by determining whether you have visited the Site in the past and which pages of our Site you have visited.

We use different methods to collect information from and about you including through:

  • Direct interactions. You may give us your Identity, Contact and Financial Data by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:

  • Third parties sources. We may receive personal information about you from various third parties as set out below:

We will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you for the purchase of goods and/or services we offer for sale through our the Site.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.

We strive to provide you with choices regarding certain personal information uses, particularly around marketing and interest-based advertising.

Promotional offers from us

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.

You will receive marketing communications from us if you have requested information from us or purchased goods or services from us and you have not opted out of receiving that marketing.

Opting out

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you, by contacting us at any by email at privacy@knackbags.com, or by contacting customer service at +1-401-404-4003.  You can also opt out by clicking on the UNSUBSCRIBE button at the bottom of email marketing. 

Where you opt out of receiving these marketing messages, this will not apply to personal information provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions. Knack will continue to send you non-promotional, service emails concerning your account, such as emails relating to available upgrades, billing and payment information, outstanding balance on your account, and other emails relating to your account.

Change of purpose

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

  1. How We May Share Your Information

We may – for the purposes set out in the table above - share information collected through the Site with our like-minded business partners for the purpose of providing you with the products and services you seek from the Site. We may also share your mailing address and shopping history with other catalog mail companies.

Additionally, in order to provide you with a better customer experience, we may share information with service providers, subcontractors, and business partners based in the United States and other countries who have been retained to perform functions on our behalf or to provide services to us. These services include:

  • Order fulfillment, warehousing, and delivery; Barrett Distribution, UPS, USPS and other delivery providers
  • Interest-based advertising, marketing, surveys, and promotions, including partnerships and teaming efforts with other companies whose products or services we think you might enjoy; Affiliate partners, Business partners, Giveaway and contests partners.
  • Information technology and office services, including software and website development, website hosting, management and evaluation, and data processing, exchange, and cross-referencing; GoDaddy, Google Analytics.
  • Payment processing services, fraud protection, and credit risk reduction; Shopify, Credit card companies, Affirm, Klarna, AfterPay and
  • Legal, accounting, audit and other professional service providers.

 

Knack may also disclose the data collected through the Site, including personal information, to another party with which Knack enters or reasonably may enter into a corporate transaction, such as a merger, consolidation, acquisition, or asset purchase. In the event that Knack or its assets is acquired by another company, or due to any merger, reorganization or liquidation, customer information may be one of the transferred assets. Your personal information will remain subject to any pre-existing privacy policy unless you consent otherwise.

We reserve the right to disclose information about you to a third party pursuant to a subpoena, court order, or other form of legal process, or in response to a request by or on behalf of any local, state, federal, or other government agency, department, or body, whether or not pursuant to a subpoena, court order, or other form of legal process.

We require all third parties to respect the security of your personal information and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

The Site may also contain links to third party websites, for the convenience of users in locating information, products, or services that may be of interest. We are not responsible for the privacy practices of such websites, advertisers, or third parties or the content of such websites and it is your sole obligation to review and understand the privacy practices and policies of these other websites. We do not control the use of cookies or the collection of information by these third parties, nor how they manage such information. If you are based in Canada you can opt out of several third party ad servers’ and networks’ cookies simultaneously by using an opt-out tool created by the Digital Advertising Alliance of Canada. Please note however that opting out of a network does not mean you will no longer receive online advertising. It does mean that the network from which you opted out will no longer deliver ads tailored to your web preferences and usage patterns.

  1. Children

The Site is not intended for children under the age of 16. We do not knowingly collect personal information online from visitors in this age group. If you are under 16, do not use or provide any information on this Site or on or through any of its features, or provide any information about yourself to us, including your name, address, telephone number, or email address. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.   1. U.S. Residents

California Civil Code Section §1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. For California residents under the age of 18 and registered users of the websites, California law (Business and Professionals Code § 22581) provides that you can request the removal of content or information you posted on Website.  Any such request should be sent to us at privacy@knackbags.com along with a description of the posted content or other information to be removed.  Be advised, however, that applicable law may not permit us to completely or comprehensively remove your deleted content or for other reasons as set forth in this California law.  

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address:privacy@knackbags.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements. 

 

Virginia residents who wish to exercise their right under the Virginia Consumer Data Protection Act (VCDPA) to opt out of the processing of their personal data for targeted advertising, personal data sales, or automated decision-making, including profiling, may submit a request to this designated address: privacy@knackbags.com. However, please know we do not currently sell personal data triggering that statute's opt-out requirements. 

 

Other states may have similar privacy rights for their residents.  Please contact us as provided below if you have any questions about exercising these rights. 

  1. International Transfers

Knack is located in the United States

The Site is hosted in the United States and is governed by United States law. If you are outside the United States when you visit the Site or engage in communications with us via mail, e-mail or telephone, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located, and our central database is operated. Knack is a US company and any information you provide to us, or that we collect through your use of our products and services and that is necessary to provide you with the products and services, will be stored, processed, and transferred within, or to, the United States. Please be aware that the US and jurisdictions other than the one in which you are located may not provide the same level of data protection as considered adequate in your country.   Note that your personal information may be available to the US Government or its agencies under legal process in the United States. 

Residents in the European Economic Area (EEA)

For residents of the European Economic Area (EEA), your personal information will be transferred to and processed in the United States, which has data protection laws that are different than those in your country and may not be as protective. 

Residents of Canada

If you are based in Canada, please note that we may process, store, and transfer your personal information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law.

 

In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this policy and applicable Canadian privacy legislation.

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

If you are based in the UK or EEA, whenever we transfer your personal information out of the EEA, such as to third party service providers, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  1. Security

The security of your personal information is important to us and Knack is committed to handling such information carefully. We maintain appropriate physical, electronic and procedural safeguards to guard your personal information. We use secure socket layer technology to protect the security of your payment information and we encrypt your personal information when it is sent over the Internet. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and personal information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Shopify

Our e-commerce store is hosted on Shopify Inc. Shopify provide us with the online e-commerce platform that allows us to sell our products and services to you.  Your data is stored by Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall. More information about Shopify’s security measures around personal information can be found here.

  1. Payment

If you choose a direct payment gateway to complete your purchase, then our service provider Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.   1. Information Retention

How long will you use my personal information for?

We will only retain your personal information for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for a longer period in the event of a complaint, if we reasonably believe there is a prospect of litigation in respect to our relationship with you or if required by law, regulation or judicial order.

In some circumstances we will anonymize your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

  1. Managing your Personal Information and Options

Under certain circumstances, you have rights under data protection laws in relation to your personal information. All users of the Site are provided the following rights and options to manage their personal information:  

  • Request access to your personal information (commonly known as a "data subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products and/or services to you. We will advise you if this is the case at the time you withdraw your consent.

No fee usually required

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you

We may need to request additional information, including limited personal information, from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it and to identify you in our systems. We may also contact you to ask you for further information in relation to your request to speed up our response.  We will not use this additional information for any other purposes.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
